Who can apply for a visa based on employment?

If you are a foreign national who can demonstrate extraordinary ability in your field, or an outstanding professor /researcher, or a multinational manager or executive, among others, then you may qualify for a visa based on employment. There are various categories to apply for employment visas including first, second, and third preference, to mention just the most common ones.

The first-preference is (EB-1) requires qualified individuals to demonstrate extraordinary ability in the sciences, arts, education, business or athletic with sustained national or international recognition. With this category, you must meet at least 3 out of 10 criteria in your field to be able to work in the USA.

If you are a professor/researcher, you must show international recognition for your achievements in your industry by meeting at least 2 of the 6 criteria required by USCIS.

For multinational managers or executives, the EB-1 category, they must have been employed outside of the United States, and the employer must be a U.S. employer wanting to transfer an employee as a manager or executive.
